Further Report on Bolton Hall

A Section 59 Notice was issued on Friday 6th November 2009 detailing the specific works required by the owner of Bolton Hall under the Notice. 

Under the provisions of the Planning and Development Act the owner may within a 4 week period from the date of the notice make a written representation to the

Planning Authority concerning:

a)    The terms of the Notice

b)    The provision of assistance under Section 59 (2) of the Planning & Development Act 2000 (as amended)

c)     Any other material considerations

The owners are then required to carry out the remedial works necessary to prevent Bolton Hall from becoming or continuing to be endangered to be carried out within a specified period of not less than 8 weeks from the date of the notice.

The Council’s Conservation Officer has been in contact with a representative of the owners to ensure that the owners understand the provisions of the Planning and Development Act 2000 and to provide the necessary advice in relation to the required works as specified in the Section 59 Notice.  After discussions in relation to the details of the Endangerment Notice the Conservation Officer was contacted by a representative of the owners to inform her that they propose that instead of carrying out temporary works i.e. Temporary roof cover it is their intention to reinstate the roof and to restore the building.  They are contacting a suitably qualified Conservation Architect to deal with these requirements to ensure all works are carried out to conservation standard.  According to the representative of the owners it is felt that they could carry out the temporary works but the problem of security on site etc will continue therefore they want to do the necessary works to the house to allow it to be lived in once again.

The Conservation Officer has provided the owners with details of the Conservation Grant Scheme for Protected Structures and has informed the representative of the owners that they must submit a formal response to the Section 59 Endangerment Notice informing the Local Authority of their intentions.  Based on this decision they must provide a Method Statement, Schedule of Works and time frame for the works to be completed.  Once the Local Authority have received the formal response to the S59 Notice the Council’s Conservation Officer can then agree details and an appropriate time frame ensuring that a written agreement is provided.
