MOTION NO. 14

MOTION: Councillor E. Maloney

That this Council opposes the processing of any planning applications by developers on land with a valuation from £5M., and which are subject to possible purchase by the National Asset Management Agency. Additionally , we urge the Minister for the Environment, Mr. Gormley to act to prevent any abuse by developers to inflate the value of their sites in advance of being purchased on behalf of the tax-payer.

REPORT:

The requirements and procedures for the processing of all planning applications are prescribed in the Planning and Development Act, 2000, and subsequent Ministerial regulations.

Under this legislation the Council is obliged to determine all valid planning applications, within specified timescales, and when doing so is expressly restricted to considering the proper planning and sustainable development of the area, regard being had to the provisions of the Development Plan, and various other statutory plans, orders, and guidelines.

The Council does not have discretion to decide whether or not to process any particular application, or type ofapplications.

 If the motion is adopted, the content will be referred to the minister for the Environment, Heritage, and Local Government.
