QUESTION NO. 9

QUESTION: Councillor C. Keane

"To ask the Manager for an update on the Whitechurch Shopping centre – re derelict site:-  I was informed on the 23rd March 2009 that “the Council has re-inspected the site since the works have been carried out and are of the opinion that the works carried out with regard to the car park are not sufficient and therefore the site remains in a derelict condition.   The procedure now is to ascertain the current market value for the site, which is being pursued by Development”

As far as I am aware no further work has been carried out at this location."

REPLY:

Whitechurch Shopping Centre was inspected by the Area Engineer on 22nd November, 2008.  The car park, foothpath and Unit 2 of the shopping centre were considered to be derelict within the definition contained in Section 3 of the Derelict Sites Act, 1990.  A Section 11 Notice was served on the owners on 16th January 2009, requesting that they repair the surface of the car park and replace the paving of the footpath to a good condition, and also requesting that Unit 2 be cleaned up and the façade painted.

As all the works outlined in the Section 11 Notice were not completed, therefore a Section 8(2) Notice was sent to the registered owners advising them of the Council’s intention to enter the site onto the Derelict Sites Register and the owners were given 28 days to make representations in writing.  The owners of the site completed the outstanding works and a further inspection of the site was carried out by the Area Engineer on the 7th August, 2009 who deemed the site to be non derelict as all works outlined in the Section 11 Notice had been completed satisfactorily.
