Cathaoirleach's Business.

This Committee concerned at the long delay in relation to the removal of the illegal mast located at Cookstown Road, Tallaght and opposite St Marks Community School calls on the manager to give a comprehensive report outlining if the mast is still in situ, the reasons behind the long delays in this case, and the next  steps, if any, this Council proposes to take in view of the court decision on  this matter.   

REPORT:

Enforcement File No. S4610 refers.   Complaints were received in relation to the erection of a mobile telecom mast at the above lands. The matter was investigated and an Enforcement Notice was served on 21st February 2008 requiring the removal of the telecommunications support mast and all associated equipment/cabinet in its entirety. As the Enforcement Notice was not complied with Legal Proceedings were initiated.  Following a further inspection on 8th October 2009 the Planning Inspector reported that the telecommunication support mast and antenna had been removed together with associated equipment and cabinets.   Accordingly as the Enforcement Notice had been complied with the Court case listed for the 13th October 2009 was struck out.

However, the inspector also noted that a new mast has been erected for use in connection with a taxi service at this location. notwithstanding the grant of permission in 2003 for "..... the retention of radio mast and of existing cabin as taxi control office" at this location under Register Reference SD03A/0317 it is the council's view that the mast now erected is unauthorised development. A Warning Letter in this regard was issued on 15th October last.A Warning Letter has also issued regarding the use of a workshop for commercial motor reoairs or other commercial business.
