MOTION NO.  4

MOTION: Councillor C. Keane

"That this Council discuss once again the Hermitage View/Ave roads access – to state if a reply has been received from the Bank of Ireland to have the land at Hermitage View/Hermitage Ave ceded to the council to enable SDCC to upgrade this road to a satisfactory standard – as developer constructed this road without planning permission and is now in liquidation."  

REPORT:

There are a number of issues which have prevented Hermitage View being taken in charge by the Council

• Access from Hermitage View to Hermitage Avenue is by way of a temporary link road which was constructed without planning permission.
• This link road has no proper footpath nor public lighting and has not been constructed to a satisfactory standard.
• The road and green strips to the side of the road are not in the ownership of SDCC.

The original developers have gone into liquidation and it is understood that the land is now under the control of the Bank of Ireland.

The Law Dept. have written to the solicitors for the Bank of Ireland enquiring if they would be prepared to cede the land to the Council to carry out the above mentioned works.

The Law Department has made recent contact by phone with the solicitors in an effort to expedite this matter. When a response is received the Committee will be informed.
