MOTION NO. 4

MOTION: Councillor C. Keane

"That this Committee discuss the request from Fonthill Park Residents Association re closure of laneway."

REPORT:

The laneway in question links Fonthill Park with Ballyboden Road and is in charge of the Council. However, title to the laneway is not registered in Land Registry. Should the Council decide to extinguish the public right of way over this laneway the residents would need the consent of the owner to effect  closure of the laneway.

There are both foul and surface water sewers in the laneway and the Environmental Services Section would require access to the laneway for maintenance purposes. In view of the above it is proposed to arrange a meeting with the local residents to clarify the issues involved.
