Re:    Proposed Transfer of Lands at Tootenhill, Rathcoole.

The Council proposes to transfer the land identified on Indicative Drawing Nos. N7/CPO1/1P/47e & f - having an area of .0286 hectares ( 286 sq. m) or thereabouts to John and Mary Cullen for the nominal sum of €100.00 (one hundred euro) in accordance with Section 211 of Planning and Development Act, 2000, Section 88 of the Housing Act, 1966 and subject to the provisions of Section 183 of the Local Government Act, 2001. (Subject to the Council, its nominees and successors in title retaining a right of way over the area).

This land was acquired from Mrs Margaret Kenny in 1959 for the purpose of construction of the Naas Dual Carriageway.  The land subsequently formed plot 47 in the South Dublin County Council Compulsory Purchase (N7 Rathcoole to Kildare County Boundary – Road Improvement Scheme) Order 2002.

The land is surplus to the Council’s requirements following completion of the Scheme.
