Re:    Proposed disposal of area of land adjacent to 124 Palmerstown Woods, Clondalkin, Dublin 22 to Paul and Veronica Hatfield – Variation to terms

The Council at its meeting held on 12th February, 2007 noted the proposal to dispose of a plot of land comprising of an area of 280sq.m. approximately adjacent to 124 Palmerstown Woods, Clondalkin, Dublin 22 to the respective houseowners, Paul and Veronica Hatfield for the consideration of €12,000.00. . Managers Order LA/24/2007 and Certified Minute C/0061/07 refer.

The Solicitors acting on behalf of Paul and Veronica Hatfield subsequently notified the Council that their clients wished to acquire a reduced area and to omit a section of the plot comprising of hedgerow and line of mature trees.

The matter was referred to the Council’s Valuer who following re-examination of the matter and taking into consideration the reduced size of plot now measuring 192 square metres or thereabouts as shown outlined in red on attached Drawing No. LA/308/06 Rev. April 2009, recommended revised terms.

I recommend therefore that in accordance with Section 211 of the Planning and Development Act, 2000 and subject to the provisions of Section 183 of the Local Government Act, 2001 that the Council vary the terms of the disposal to Paul & Veronica Hatfield, 124 Palmerstown Woods  as noted by the Council at its meeting held on 12th February, 2007 to provide for the following amended terms.

1.               That the Council dispose of the freehold interest in the subject plot comprising of 192 square metres or thereabouts as shown outlined in red on Drawing No LA/30B/06 –Rev. April 2009 for the consideration of €8,000 (eight thousand euro).

The terms of the disposal as noted by the Council at its meeting held on 12th February, 2007 otherwise to remain unchanged.
