QUESTION: Councillor W. Lavelle
To ask the Manager to advise on the council’s powers with regards to addressing anti-social behaviour by tenants accommodated under the Rental Allowance Scheme?
REPLY:
Under the terms of the Rental Accommodation Scheme the landlord is responsible for addressing anti-social behaviour by tenants, any members of their household or their guests. This is made clear to landlords during the course of negotiatioons and there is a penalty clause in the contracts to deal with landlords who fail to engage with their tenants when complaints are made regarding their behaviour.
South Dublin County Council has a policy of carrying out background checks including Garda checks before offering accommodation under the scheme to tenants.
South Dublin County Council assists and advises the landlord in such instances where necessary. The landlord can also refer the matter to the Private Residential Tenancies Board for mediation or a tribunal hearing.
