Re:    Proposed Transfer of Lands at Lucan to Mrs. Una Duke, Personal Representative of Mr.Kevin Duke (Deceased), Dun Mhuire, Lucan Road, Leixlip.                                                         

The Council proposes to transfer the site identified outlined in red on Drawing No. LA/12/09 having an area of 1580 sq. m or thereabouts to Mrs. Una Duke, Personal Representative of Kevin Duke (Deceased), Dun Mhuire, Lucan Road, Leixlip, in accordance with Section 211 of Planning and Development Act, 2000, Section 88 of the Housing Act, 1966 and subject to the provisions of Section 183 of the Local Government Act, 2001. 

 The proposed transfer of the above mentioned lands is to complete an arrangement between Kildare County Council and Mr. Kevin Duke (Deceased) which formed part of the “agreement” relating to the acquisition of lands to facilitate the construction of the Motorway Scheme for the Kilcock Maynooth Leixlip By Pass.  The Road Scheme in the County Council area included land acquisition was carried out by way of a Section 59 Agreement by Kildare County Council.

 The above lands which are now being transferred to Mrs. Una Duke, Personal Representative of Kevin Duke (Deceased) were acquired from Lismore Homes Limited (now in receivership).  The lands in question had been acquired by Dublin County Council on foot of a planning permission for the proposed N4 Improvement and these lands have only been registered to the Council in late 2008.
