MOTION: Councillor S. Crowe

"This Committee calls on the Manager in view the wide scale of prices being charged for land in many Tallaght Estates over the years, where resident were looking to take in charge lands, where anti social behaviour regularly occuring ,and calls on him to give report outlining  how his Department ascertains a valuation made on land adjoining properties in many of these cases." 

REPORT:

In circumstances where adjoining landowners wish to acquire small areas of land/portions of laneways etc in Council ownership for incorporation into their properties, the views of various departments of the Council and utility Companies are sought to ascertain the availability of the land for sale, impact of any services, history of any estate management issues pertaining to the site, development potential etc. If the land does not require to be retained in public ownership and providing the Council holds good title, the Chief Valuer is instructed to recommend a valuation for the plot of land/laneway taking into account the above criteria and reflecting the state of the market pertaining at the date of valuation.

In considering estate management issues, the Department who has day to day control of the land in question, i.e Housing Department for incidental plots of lands or laneways within Council estates or Parks Departments where open space lands are concerned, would normally refer to incidences of anti-social behaviour on the lands and make a recommendation on this aspect as part of their reports, which in turn would be notified to the Chief Valuer to inform his valuation. In the interest of fairness and equity, however, regardless of evidence of anti-social behaviour etc the development potential of the site and the value it would add to an existing property would have to be taken into account e.g. some properties may gain space for side entrances where none previously existed,  space to extend and enlarge dwellings and in some cases purchasers have subsequently proceeded to obtain planning permission for additional houses on plots initially acquired due to allegations of anti-social behaviour.

Once terms are agreed between the parties these are placed before the Elected Council for consideration.
