MOTION NO. 5
MOTION: Councillor C. Keane
"That this Committee discusses with the aid of a full report on the request to have the boundary area adjacent to 220 Moyville Estate taken into garden & regularised – request outstanding for some considerable time and to state will it be brought to the next council meeting – was told in Feb. that you were awaiting map from Reg. office, this should be available now."
REPORT:
The legal title to the open space lands adjoining the above property has yet to be transferred to the Council and until such time as the Council is registered as owner of the lands in Land Registry, it is not in a position to transfer title to any other party. There had been considerable difiiculties in engaging with the developer and his solicitors over the years. However a new solicitor has since been appointed to act for the developer and the Council is actively pursuing the matter with this solicitor at the present time. Revised maps of the lands, which will comply with current Land Registry requirements, are being prepared by the Council's Parks Department and the Land Registry map referred to in the motion was required to assist in this matter . On receipt of the acquisition maps, the Council's solicitor will be instructed to finalise the transfer of title.
Once the Council is satisfied that it has good title to the lands, terms will be issued to the owners of the above property for the disposal of the section of land already incorporated by them into their property. In the event of terms being agreed, the matter will be brought to a future meeting of the Council for consideration by the members. The Council is not in a position to bring the matter to the next Council meeting on 11th May 2009 as it does not as yet have title to the lands and terms have not been finalised.
