MOTION NO.  3

MOTION: Councillor J. Hannon

"That urgent action be taken to deal comprehensively with the ongoing problem of dumping, lighting of fires, use of motorbikes and quad bikes at Dodder Valley near Old Mill, with resultant danger and nuisance to local residents, and that the question of the securing of these lands be also addressed".

REPORT:

This site was inspected by the Area Engineer on the 20th June, 2008 and was found not to be derelict within the definition contained in Section 3 of the Derelict Sites Act, 1990.   The Area Engineer has been requested to carry out a further inspection of these lands to ascertain if they are derelict.  If following this inspection the land is found to be derelict, appropriate action will be taken in accordance with the provisions of the Act. The issue of the use of the lands by motor bikes and quad bikes will be taken up with the owner of the lands and will also be referred to the Chief  Environmental  Health  Officer  for examination under the noise pollution legislation.

The matter relating to dumping has been referred to Environmental Services Department for  inspection.  On receipt of reports following both inspections an update will be given to the Councillor.
