QUESTION NO. 2

QUESTION: Councillor E. Maloney

To ask the Manager what action is open to the Council to terminate trading at *(details supplied) which is a residential estate and will he note the considerable nuisance being caused for affected neighbours.

REPLY:

Planning Enforcement Reference No. S6002 refers.  Complaints were received in Planning Enforcement on 26th March 2009.  A Warning Letter pursuant to Section 152 of the Planning & Development Acts, 2000 - 2007 issued to the owner/occupier on 16th April 2009 for alleged unauthorised development consisting of the operation of a car/motor sales business from the dwelling without the benefit of Planning Permission.

As a person served with this letter, the owner may make submissions or observations in writing to the Planning Authority regarding the above (which, if true, would constitute an offence under the Planning & Development Acts, 2000 - 2007) not later than four weeks from the date of the service on them of this Warning Letter i.e. 19^th May 2009.

A decision will be made as to further enforcement action after this date.
