QUESTION: Councillor M. Murphy
"Could the Manager confirm that Litter Wardens have the power to ask for waste that is visible from a public place but on private property (in Front gardens etc) be removed ?"
REPLY:
The Council’s Anti-Litter Wardens are responsible for the enforcement of the Litter Pollution Act, 1997, as amended, and Section 6 deals with the duty of occupiers, etc., regarding littering. This section places various requirements on occupiers and includes the responsibility to keep any land that is not a public place free of litter that is to any extent visible from a public place. These requirements include the responsibility to keep front gardens clear and Anti-Litter Wardens regularly deal with complaints of this nature and will, in the first instance, generally call out and request that the area in question be cleaned. If this does not resolve the matter, enforcement proceedings are then taken by the Warden.
