Re:    Proposed Transfer of lands at  Saggart  to Dublin City Council

South Dublin County Council acquired approximately 11.5 acres of land at Saggart from Mr John Kelly, partly to facilitate the Boherboy Water Supply Scheme and partly on behalf of Dublin City Council who also own a water reservoir in adjoining lands.  The breakdown of the areas required by each authority is as shown on Indicative Drawing No. 20154/LA/01 and marked as follows:

·        Area outlined in red on Indicative Drawing. No. 20154/LA/01 comprising an area of 4.2 hectares or thereabouts acquired for South Dublin County Council.

·        Area outlined in red and shaded blue on Indicative Drawing. No. 20154/LA/01 comprising an area of 7.16 hectares or thereabouts acquired on behalf of Dublin City Council.

·        Area outlined in green to which Vendor held possessory title only comprising 0.11 acres or thereabouts acquired on behalf of Dublin City Council.

The title to the major part of the lands has now been registered in the name of South Dublin County Council with a small plot of unregistered land still under examination by the Property Registration Authority. It is now proposed to proceed with the transfer of the registered portion of the lands required by Dublin City Council at this stage. The unregistered portion as shown outlined in green on map may be transferred to Dublin City Council , if required , at a future date if the title is registered  in Land Registry.

I recommend therefore that the Council dispose of a plot of land comprising of  7.16 hectares or thereabouts as shown outlined in red and shaded blue on Indicative Drawing No.20154/LA/01 together with plot shown outlined in green comprising 0.11 acres or thereabouts, if registration of title is finalised, to Dublin City Council in accordance with Section 211 of the Planning and Development Act, 2000 and subject to the provisions of Section 183 of the Local Government Act, 2001 subject to the following terms and conditions :-

 

  1.  That the landsbeing disposed ofat this stage comprise of an area of 7.16 hectares or thereabouts as shown outlined in red and shaded blue on Indicative Drawing. No. 20154/LA/01.
  2.  That the plot shown outlined in green on Indicative Drawing. No. 20154/LA/01 comprising 0.11 acres or thereabouts shall be disposed of to Dublin City Council, in the event of the title being registered by the Property Registration Authority. 
  3. That Dublin City Council pay the sum of €1,228,715.86 which represents the cost to South Dublin County Council of acquiring these lands including purchase price, apportionment of stamp duty,  legal and Valuer’s fees. 
  4. That each party are responsible for their own professional fees in relation to this Transfer. 
  5. That South Dublin County Council shall prepare accurate maps of the lands to be transferred. 
  6. That the County Solicitor shall draft the necessary legal agreements and may include further terms and conditions or make such reasonable alterations, additions and modifications thereto as he deems appropriate.

                                                                          

The lands to be disposed of form part of lands acquired from John Kelly in 2003 for Environmental Services purposes.
