QUESTION: Councillor C. Keane

"To ask the Manager for an update on the derelict site notice served on the owners of Whitechurch shopping centre?"

REPLY:

Whitechurch Shopping Centre was inspected by the Area Engineer on 22nd November, 2008.  The car park, foothpath and Unit 2 of the shopping centre were considered to be derelict within the definition contained in Section 3 of the Derelict Sites Act, 1990.  A Section 11 Notice was served on the owners on 16th January 2009, requesting that they repair the surface of the car park and replace the paving of the footpath to a good condition, and also requesting that Unit 2 be cleaned up and the façade painted.

These Notices expired on 2nd March and the site was re-inspected.  It had been found that the works requested at Unit 2 have been carried out, the repair works to the surface of the car park and the repair/replacement paving of footpath to a good condition are still outstanding.  A Notice under Section 8 of the Derelicts Sites Act has been served on the owners informing them of South Dublin County Council's intention to enter this site on the Derelict Sites Register.  The owners have 28 days to make in writing representations as they think fit, such representations shall be considered by the local authority who will then make the decision to enter or not enter the site on the register
