QUESTION: Councillor R. Dowds

To ask the Manager to outline the bye-laws regarding street tradings?

REPLY:

The Council's Casual Trading Bye-Laws regulate trading activities such as selling fast food from vans, selling flowers from vehicles or stalls and other street market type activity in the County. Under the Casual Trading Act, 1995, the Council may designate sites or places where casual trading is permitted and may issue Casual Trading Licences on payment of the appropriate fee.  Only persons witha valid Casual Trading Licence may trade at the designated sites.

The current designated casual trading sites and the type of trading permitted are as follows: Fettercairn Community Centre (Market – General goods); Cheeverstown Road (Site “A”) (Food) ; Cheeverstown Road (Site “B”) (Food); Killinarden Ring Road at Bus Terminus (Food) ; Oak Road, Western Industrial Estate (Food) ; Lower Ballymount Road (Food) ; Esker Cemetery (Flowers and grave ornaments) and Bohernabreena Cemetery (Flowers and grave ornaments).  The current fees for the licences are Burial Grounds (Flower Sellers)-€253.95, Food Outlets-€380.92 and Fettercairn Market-€12.70.

Due to the limited number of designated casual trading sites in the County, new applications are not currently being considered.

Complaints about illegal casual trading are investiaged by the Council's Anti-Litter Wardens, who are authorised persons under the Casual Trading Act, and the Council may initiate legal proceedings to proescute persons suspect of illegal casual trading with penalties as stipulated in the Act.
