"That the Manager outline if the advertising signs erected by Paddy Power Bookmakers on Wainsfort Drive require planning permission and if so has permission has been requested or granted. If these signs are not legal will he ensure that they are removed."
REPORT:
Complaints were received in relation to the erection of two large signs advertising Paddy Power Bookmakers located beside the Two Sisters Public House, without the benefit of Planning Permission.
A Warning Letter pursuant to S152 of the Planning & Development Actsc 2000 - 2007 issued to the owner/occupier in relation to the above on 12th February 2009. As a person served with this letter the owner/occupier may make submissions or observations in writing to the Planning Authority regarding the above (which, if true, would constitute an offence under the Planning & Development Acts, 2000 - 2007) not later than four weeks from the date of the service on the owner of the Warning Letter, i.e. 18th March 2009.
The matter is currently being investigated to ascertain whether or not the advertising signs at the above location require Planning Permission or can be classed as Exempt.
Advertisements exhibited on business premises, wholly with reference to the business or other activity carried on or the goods or services provided on those premises, are considered Exempted Development provided certain conditions and limitations are met.
The Councillor will be kept updated on the matter as it progresses.
