MOTION: Councillor C. Brophy
"That the Manager provide an update on McHughs derelict site and on contacts which the Council have had with the owners and their compliance with the derelict site order."
REPORT:
The site of the former Greenhills Shopping Centre was inspected by an Area Engineer on 1st September 2008 and was considered to be a derelict site within the definition contained in Section 3 of the Derelict Sites Act, 1990. A Section 11 Notice was served requesting the following works to be carried out:
The Notice expired on the 27th November, 2008. On the 28the November 2008 the site was re-inspected and it was ascertained that all the works outlined in the Section 11 Notice had not been completed.
Correspondence has been received stating that works are expected to commence in February 2009 at this location in respect of Planning application SD07A/0062.
The site was entered into the Derelict Sites Register on 19th December, 2008 and a Section 22 Notice was served on the owner on 14th January, 2009, for the purposes of implementing the levy and advising him of the determined market value. The owner has 28 days from this date to appeal to the Valuation Tribunal.
Should development of the site commence in February 2009 as indicated, the site will then be removed from the Derelict Sites Register.
