Proposed Plebiscite for Palmerston / Palmerstown
The following report was presented to the LCACM (1) meeting of 3rd December 2008
"Since the last report on the proposed holding of a plebiscite was presented in September 2008 considerable progress has been made in conjunction with local elected members on determining the composition of a draft list of "Qualified Electors".
In accordance with S 67 of the Local Government Act 1994 "Qualified Electors" means
*every person which in relation to the urban district, town, townland, non-municipal town, street or locality (as the case may be) is registered as a local government elector in the Register of Local Government Electors for the time being in force.
*not being so registered, is the rated occupier of a hereditament other than a hereditament the valuation of which attracts an allowance equal to full abatement of rates pursuant to section 3 of the Local Government (Financial Provisions) Act, 1978
It now appears that the draft list of Qualified Electors should comprise of all those electors registered on the Live Register of Electors for the Polling Districts of Palmerston 1(Register Book FJ), Palmerton 2 (Register Book FK) & Cherry orchard (Register Book FI) and the proposed draft list is attached for your consideration, with the exception of two entries outlined in red. It should also be considered at this time an area to the east of the M50 currently under development at Coldcut, which is included in Register Book FG but which does not currently have registered electors should ultimately be included in the overall area or locality of Palmerston / Palmerstown.
It is a matter for the members of this Committee to make a recommendation to full Council in relation to formal initiation of the proceedings including publication of the draft list of Qualified Electors for a statutory period of three weeks.
Once again it should be borne in mind that in order for this Council to change the name of the locality it must receive the consent of the majority of potential electors. The impact of the outcome of the plebiscite on other public bodies should also be borne in mind. End of Report to LCACM (1) Nov 2008.
Having considered the report and maps circulated this committee agreed to defer determining the draft list of qualified electors until the December meeting. However it was agreed that an area to the east of the M50 currently under development at Coldcut, which is included in Register Book FG but which does not currently have registered electors should ultimately be included in the overall area or locality of Palmerston / Palmerstown. It was formally AGREED to ititiate proceedings, commenciing with publication fo the Draft List of Qualified Electors, to take the Plebiscite on the basis of the draft list of Qualified Electors as outlined in the report presented to the LCACM (1) dated 3rd December 2008.
This council has already resolved (July 2008) to conducts a plebiscite to establish the consent of the "qualified electors" to officially change the name of Palmerston to Palmerstown and this report from the LCACM (1) Meeting dated 3rd December 2008 in relation to consensus on the draft list of “Qualified Electors” for public inspection is for information purposes. However the council will be required to formally adopt the list of Qualified Electors following the formal public consultation process.
