MOTION: Councillor T. Ridge
That this Council ask the Minister for Environment, Heritage and Local Government to strenghten the powers of Local Authorities to deal with anti - social behaviour.
REPORT:
Housing Authorities have powers in relation to anti-social behaviour in social housing under the Housing Act 1966 and the Housing (Miscellaneous Provisions) Act 1997. These powers will be further strengthened by proposed amendments which are contained in the Housing (Miscellaneous Provisions) Bill 2008. The Council has an Estate Management Team in place and it is proposed to bring a redrafted Anti-Social Behaviour strategy document to a sub group of the Housing and Social Strategic Policy Committee early in the new year. This document will be guided by the provisions of the Housing Bill 2008.
The Council has engaged in legal proceedings to recover homes from a number of families for anti-social behaviour over recent years but very robust legal challenges,such as applications for Judicial Review to the High Court have been mounted in defence. An analysis of activity in respect of anti-social behaviour is set out in the table below.
