Proposed Extinguishment of Public Right of Way at rear of 58/62 and 63/68 Balrothery estate, Tallaght, Dublin 24. Map Ref: RE 0624

The following report was submitted to the Tallaght Area Committee Meeting (2) on the Monday 22nd September, 2008.

“An application was received from the residents of Balrothery Estate to formally extinguish the public right-of-way at the rear of 58-62 and 63-68 Balrothery Estate, Tallaght, Dublin 24, due to anti social behaviour.  It is proposed to effect the closure by means of a wall and gate.”

Following consideration of the report, it was agreed to initiate the procedure.

The proposal to extinguish the public right-of-way was advertised in the Echo on Wednesday 1st October, 2008 and signs were erected on site in accordance with Section 73 of the Roads Act, 1993.  The latest date for receipt of objections, representations and requests for an oral hearing was Friday 14th November, 2008. 

No submissions were received in response to the public advertisement/notice. 

Bord Gais and Eircom have no objections to the proposed extinguishment. 

ESB have no objection but must be contacted prior to any works being carried out. 

NTL have no objection but have stated that there are services adjacent to location and an NTL Plant Protection officer to be present during any works. 

Water, Drainage and Public Lighting Sections have no objection. 

The Council has no power to sanction the erection of gates.

The Housing Department has agreed to finance the cost of the works.

The decision regarding the extinguishment of a public right-of-way and the granting of an oral hearing is a reserved function of the Council. 

Any recommendation of the Committee will be brought to the attention of the Council.
