MOTION NO. 11

MOTION: Councillor M. Ardagh

"That the Manager give a report on the present status of the complaints made by local residents in relation the SLM building yard at the rear of Muckross Avenue and to ask if any progress has been made in relation to environmental health concerns regarding noise and if any evidence has been submitted by residents that would assist in the Council taking legal action against the yard."

REPORT:

The following was stated at the Terenure-Rathfarnham Area Committee(2) meeting on the 11th December 2007

"The Principal Environmental Health Officer has reported that previous monitoring of this location, from the home of one of the residents adjacent to the builders yard, failed to establish an air pollution or noise pollution nuisance. The Environmental Health Department has recently purchased new monitoring equipment and proposes to carry out additional moniotoring early in the New year to establish an up to date position"

The Environmental Health department has reported no further complaints regarding this site however the matter will be re-examined again in light of this motion from the Councillor.
