QUESTION: Councillor S. Crowe
"To ask the manager will he give an updated report regarding the illegal encampment at the rear of housing on fortunestown lane that has been the subject of headed items at council meettings last year?"
REPLY:
A Letter threatening an Injunction pursuant to Section 160 of the Planning and Development Act 2000, dated 15th May 2006 was served on the owners of Lands at Fortunestown Lane, Tallaght, Dublin 24. This Letter required that within 4 weeks of the date of the letter that (i) The use of the lands for the storage of caravans/mobile homes and motorised campervans cease, (ii) the use of the lands for the storage of motor vehicles / vans used in the construction industry cease and (iii) the use of the lands for the storage / distribution of building materials and commercial use cease.
As the requirements of the letter were not complied with, the County Law Agent was instructed to initiate legal proceedings seeking Circuit Court Orders against the land owner requiring the following; (i) the use of the lands for the storage of caravans/mobile homes and motorised campervans cease, (ii) the use of the lands for the storage of motor vehicles / vans used in the construction industry cease and (iii) the use of the lands for the storage / distribution of building materials and commercial use cease.
The matter was listed for mention before the Circuit Court in July 2008, wherein the case was adjourned till October 2008 and then further adjourned till 13th November 2008, so as to consider and reply to the Defendant's affidavit. The matter is listed in the Circuit Court on 11th December 2008.
The Councillor will be kept informed as the matter progresses.
