QUESTION: Councillor T. McDermott

To ask the Manager to report on the number of actions initiated under the Derelict Sites Act in recent years, the number that were successfully completed by SDCC and the number of cases the were lost and the number of cases dropped or abandoned and would he make a statement on the matter ?

REPLY:

In 2008 an interdepartmental approach was taken to eliminate dereliction and litter black spots within the County.  The Development and Environmental Services Departments met with Elected Members to identify sites and properties of concern within their electoral areas.  These areas were inspected and Notices were served where appropriate.

The Derelict Sites Act 1990 gives the Council the powers to deal with dereliction within the County.  Sites are inspected by Area Engineers and if found to be derelict  a Section 11 Notice is served on the registered owners instructing them to carry out works in order to render the site non-derelict.  If the owner does not comply with the Notice the case is referred to the Law Department where legal proceedings are initiated.  In 2008, to date, 75 sites were inspected, 43 Section 11 Notices were served and legal proceedings were initiated in 7 cases.
