Proposed disposal of area of laneway at rear of 36 Lindisfarne Avenue, Bawnogue, Clondalkin,  Dublin, 22 - Jacqueline and Michael Cummins

Report

An application has been received from Jacqueline Cummins and Michael Cummins, 36 Lindisfarne Avenue, Bawnogue, Clondalkin, Dublin 22 to incorporate a portion of laneway at the rear of their house  as it is no longer in use for access purposes.

Accordingly, I recommend that the Council dispose of an area comprising 19 square metres or thereabouts to the rear of 36 Lindisfarne Avenue, Bawnogue, Clondalkin, Dublin, 22, as shown outlined in red on Drawing No. LA/38/08 to Jacqueline and Michael Cummins in accordance with Section 211 of the Planning and Development Act, 2000 and subject to the provisions of Section 183 of the Local Government Act, 2001 subject to the following terms and conditions as recommended by the Council’s Valuer:-

  1. That the Council dispose of the subject plot for the consideration of €1000 (one thousand euro)
  2. That the land be disposed of with full freehold title and vacant possession.  
  3. That the applicants shall pay the Council’s legal fees.
  4. That the applicants will be responsible for the removal of any services on the subject land and for carrying out a survey to determine the location of the lighting cables on the subject plot.
  5. That the applicants incorporate the area into their rear garden and construct a suitable boundary wall, to match and tie into existing boundary walls, the details of which are to be agreed with the Council at a later date. No access to be allowed from adjoining lane.

                                                                                                   

The lands to be disposed of form part of lands acquired from Daniel and Johanna Moynihan in 1974 for housing purposes.
