QUESTION: Councillor J. Neville

" To ask the Manager for a detailed update on when Belgard Green estate was taken in change and can the Manager confirm if the large Manhole in the side garden of address ....*details supplied,  is in full compliance with the granted permission for this development and will the Manager note that the existence of such a Manhole is inhibiting the submission of a Planning Application on corner site of the above address?."

REPLY:

"Planning permission was Granted on 30th June 1994 for the following proposed development under Register Reference S94A/0067;

"16. no. 4-bedroom and 57 no. 3-bedroom houses with access to Cookstown Road" on lands at Cookstown Road, Tallaght. 

This development was subsequently named Belgard Green.  The only way to confirm whether the manhole in question is located in compliance with the planning permission granted is to have an inspection of the lands carried out.  However, as this development is over 7 years old, an enforcement action in relation to the drainage layout is statute barred, and as such it is not considered expedient to carry out such an inspection.

Belgard Green was Taken In Charge on 09/07/2001".
