REPORT ON PROPOSED EXTINGUISHMENT OF PUBLIC RIGHT OF WAY AT  ENTRY TO THE OPEN SPACE FROM AVONDALE TERRACE, DUBLIN 12.

 

The following report was considered at the Terenure/Rathfarnham Area Committee Meeting (1) on the 8th April 2008.

“A petition was received from the Avondale Terrace Residents Association to formally extinguish the public right-of-way at the entry to the open space from Avondale Terrace, Dublin 12, due to the anti-social behaviour and closure is to be effected by means of a decorative railing and hedging. Works to be carried out by the Parks Department.”

Following consideration of the report, it was agreed to initiate the procedure.

The proposal to extinguish the public right-of-way was advertised in The Echo, Wednesday 7th May 2008, and signs were erected on site in accordance with Section 73 of the Roads Act, 1993. The latest date for receipt of objections, representations and requests for an oral hearing was 4.30p.m. on Friday 20th June 2008.

No submissions were received in response to the public advertisement/notice.

Bord Gais, Eircom and ESB have stated that they have no objections to the proposed extinguishment.

NTL has no objections to the proposed extinguishment but request that they be contacted in advance of any works regarding the possibility of old network at this location.

Public Lighting Section and Drainage Sections have no objections to the proposed extinguishments.

Water Section has no objection to the proposed extinguishment but there are plans to run a main down the laneway.

 Any recommendation of the Committee will be brought to the attention of the Council.
