QUESTION: Councillor E. Walsh

"To ask the Manager to update the Committee on the enforcement action being taken at the Promster Developments site beside St. Peter's BNS on Limekiln Road?"

REPLY:

Following receipt of complaints in Planning Enforcement, and inspections by the Planning Inspector, an Enforcement Notice pursuant to Section 154 of the Planning & Development Act 2000 dated 28th August 2008 was served on Promster Developments Ltd requiring on/before 1st September 2008 to take the following steps to secure the carrying out of the development in accordance with the planning permission granted under Reg. Ref. SD05A/0847, that is to say:-

Cease all works on site until submissions pertaining to Condition Nos. 2, 4, 5, 7, 9, 11, 12, 13, 15 and 17 of Planning Permission granted under An Bord Pleanala Ref. No. PL06S.215659, Reg. Ref. SD05A/0847, have been submitted to the Planning Authority for agreement.

The Planning Inspector has reported that no further works have been carried out on site, and that works have ceased in compliance with the Enforcement Notice.  To date no compliance submissions have been lodged with the Planning Authority.
