QUESTION NO. 14

QUESTION: Councillor S. Crowe

"To ask the manager in view of the difficulties being experienced by the Councils Parks Department maintaining  can he give an updated report regarding the two  enforcement notices that were served in  relation to concrete rubble  left on the greenspace between 2a and 2 Maplewood Park, Springfield and what works if any have been carried out?"

REPLY:

Following receipt of complaints in relation to damage to the grass verge between 1A & 2A, Maplewood Park, Springfield, Tallaght, an investigation was carried out and it was found that the green area in question was located adjacent to the subject site referred to in Register Reference SD06A/0579. This application refers to "Two storey dwelling attached onto side of existing dwelling house and for new vehicular access and off street parking to front." at 1, Maplewood Park.

Condition No. 6 of the Planning Permission granted states:

"Access to the proposed dwelling shall be from the vehicular entrance to the front of the existing dwelling. Prior to the commencement of any development on the site, the applicant shall submit revised drawings showing the vehicular entrance to the front of the proposed dwelling omitted."

A Warning Letter pursuant to S152 of the Planning & Development Act 2000 issued to the owner/occupier of 1, Maplewood Park in relation to non-compliance with Condition No. 6 of planning permission granted under Reg. Ref. SD06A/0579 in that no revised drawings showing the vehicular entrance to the front of the proposed dwelling omitted have been submitted to the Planning Authority. A compliance submission was subsequently received in relation to Condition No. 6 and accordingly there is no further enforcement action warranted in relation to this matter.

The issue in relation to damage to the grass verge was referred to the Roads Department for investigation.
