QUESTION NO. 4

QUESTION: Councillor K. Warren

To ask the Manager if he would agree to allow the residents at *Details supplied to incorporate a disused laneway at the back of this person’s property, which is completely inoperable and has already been closed off by South Dublin County Council, and given the fact that this laneway has not been cleaned for 5 years, if a laneway cleanup can be organised, and if he will make a statement on the matter?

REPLY:

An application from the houseowner in question ,at Tymon North , to incorporate a portion of laneway at the rear of his property is being examined by Development Department at present,in conjunction with other departments of the Council and utility companies.  The section of laneway at this location appears to span the rear of three houses and it would be preferable if the full area were to be incorporated into the adjoining gardens, in the event that no objections are received and that the public right of way over the laneway has been extinguished. In particular, the section of laneway to the east of the property referred to in the question would be landlocked for maintenance purposes unless the owner of the adjoining house incorporates it into his property.

An updated Folio Map is also awaited from The Property Registration Authority as the registered boundary along this laneway where it adjoins the Industrial Estate was somewhat irregular in pattern and may need to be regularised prior to any disposal of property.

The matter of a cleanup of the laneway has been referred to the Housing Department for attention.
