QUESTION NO. 22

QUESTION: Councillor E. Walsh

"To ask the Manager to provide a report on abandoned cars at the entrance to St Killian's Avenue and Council policy in place in this area?"

REPLY:

There has been a complaint received about one potentially abandoned vehicle at this location which is being investigated by the Litter Warden for the area.  There are registration plates on the vehicle in question so the Motor Tax Authority has been requested to provide details of the registered owner of the vehicle in order to allow the owner to be contacted.

Section 71 of the Waste Management Act, 1996 as amended is the governing legislation in this area.  Generally, where vehicles are abandoned, have no registration plates or other identifying marks and the Council is of the opinion that the vehicle is not capable of reasonably being used as a vehicle, Litter Wardens will arrange for the Council's contractor to remove and dispose of the vehicle.  Where vehicles’ owners can be identified a notice can be served advising them that the car will be taken into storage and disposed of if not claimed after the specified period.
