QUESTION: Councillor P. Cosgrave
"To ask the Manager to give a report on the ongoing delays of the handing over to the management committee of Edenbrook Manor Ballyboden from the developer Clayworth and what powers can the Council use to remedy the situation?"
REPLY:
Edenbrook Manor was developed under planning permission Reg. Ref. 096A/0159 by Clayworth Investments Ltd .
The legal timeframe for taking legal enforcement action in respect of this development has expired.
A meeting took place on Thursday 21st September 2006 at County Hall Tallaght, between representatives of the residents of Edenbrook Manor and representatives of the developers, Clayworth Investments Ltd.
The purpose of this meeting was to discuss arrangements for the handover of the responsibility of the maintenance and up-keep of the common areas in Edenbrook Manor to a management company controlled by the residents of the estate.
The residents of Edenbrook Manor and the developer agreed to maintain contact in order to progress the issues which needed to be resolved to facilitate the handover of the estate.
However contacts with the residents of Edenbrook Manor and the developer has revealed that
the issues which have arisen regarding the handover of the estate remain unresolved and that contacts between the parties had discontinued.
Further efforts will be made to bring both parties together again, with a view to bringing this matter to a satisfactory conclusion.
