QUESTION: Councillor J. Neville
"To ask the Manager for a detailed update on proposals to extinguish the right of way at *details supplied with specfic reference to the construction of a wall at this location?"
REPLY:
An application was received from residents of Balrothery Estate to formally extinguish the public right-of-way at *details supplied. It was agreed to initiate the procedure and subsequently the Notice of Intention was advertised in the newspaper on November 9th, 2006.
The residents requested that the wall to the rear which bounds the open space and which had been knocked down in places be rebuilt and extended a couple of feet to close off the access should the extinguishment go ahead.
A site meeting was held with the Parks Department on the 14th May, 2008 requesting reinstatement of the existing wall and continuation of wall to close off access to facilitate the extinguishment/closure. Having further examined the matter the Parks Department have reported that “while Parks Department have no objection to the construction of a wall at the laneway adjacent to *details supplied to extinguish the right of way, we do not take in charge or maintain boundary walls. As responsibility of these boundary walls has been an on-going issue for many years and as a result the Parks Department will not build the wall at this location.”
Given the current proposal to extinguish the laneway, any works or costs involved in effecting the closure would be a matter for the residents concerned which would include the building / rebuilding of wall/ fence, acquisition of title etc. It has also been confirmed that there are services at this laneway which would involve relocation and the costs of their relocation would also have to be borne by the residents.
