McHughs Shopping Centre, St. James Road, Greenhills

Set out hereunder are a list of motions brought before the Terenure Rathfarnham Area Committee in relation to McHugh’s site at St James Road, Walkinstown.

Terenure Rathfarnham Area Committee meeting 6th February 2007.

Motion No.3 Proposed by Councillor C. Keane and seconded by Councillor T. McDermott.

"That this committee discusses the urgency of ensuring the development of the site at the old shopping Centre (McHugh’s) on St. James’s Road Greenhills now that the most recent planning application was declared withdrawn this month as the applicant (McHugh’s) did not submit the required additional information as requested. This is at least the 3rd planning application on this site.  It was agreed following my question put at the Council meeting 6th April 2006 –almost a year ago - that a Compulsory Purchase order would be initiated. I was subsequently informed that site drawings for the CPO were being prepared and that the CPO was imminent, this was over 5 months ago. As this site is a total eyesore and the facilities e.g. shops, chemist, Post Office are greatly missed in the community, could the CPO be speeded up as it is obvious – once more by allowing withdrawal of current application– that the applicants have no intention of developing this site in the immediate future. The current derelict situation on this site for over 4 years must not be allowed to continue. " 

It was agreed that a further report would be issued to the March meeting of the committee.

Motion No. 20 proposed by Councillor S. Laing and seconded by Councillor T.McDermott.

“That the Manager give an up to date report on the planning application for the Shopping Centre in Greenhills Estate and the present position on the C.P.O.”

The site will continue to be monitored under the Derelict Site Legislation.

Motion No.5 proposed by Councillor E. Walsh and seconded by Councillor T. McDermott.

"That the Manager report to up date this Committee on the status of the CPO on the derelict site on St. James Road and any other relevant information." 

New Planning Application received in respect of the site (Reg. Ref SA07A/0662 refers)

Motion No.12 Proposed by Councillor E. Walsh and seconded by Councillor S.Laing.

"That the Manager update this Committee on progress in developing the derelict old shopping centre on St. James Road, Greenhills noting the promise made by the owner to start development last may and to take any action that will ensure the re-development of the site and to also note that following the removal of the C.P.O. seems to have enabled the developer not to proceed with re-development."

Moveable waste has been removed and Management Company are monitoring to ensure against trespass and further dumping.

Motion 10 proposed by Councillor C.Keane and seconded by Councillor S.Laing.

“That this committee discuss with the aid of planning advice on how to proceed with a view to setting a last date for submission of the - commencement notice - at McHugh's Shopping centre area St. James Rd Greenhills and if not complied with to reactivate the CPO currently outstanding on this site”.

The developer indicated that he proposed to commence work in November 2007.

Motion No.6 proposed by Councillor E. Walsh and seconded by Councillor C.Keane.

“That the Manager in view of the failure of the developer of the derelict shopping centre site to proceed with the development as agreed last May that the C.P.O. be re-introduced and to state that local residents are sick and tired of the false promises as they look onto a most offensive site in the heart of its community”.

Dublin Fire Brigade sought an extension of time to consider the application for a fire Safety Certificate. It was hoped that development commence early in the new year.

Motion No.2 proposed by Councillor C.Keane and seconded by Councillor T. McDermott.

"That this committee discusses the McHugh's ex-shopping centre site - it is now a derelict site for some time. That the Manager initiate the CPO on this site as agreed previously as development of this site is obviously not taking place and the local community cannot be left without shops, Post Office and local facilities that were there previously. I was informed previously that building was to start over 3 months ago. If a housing estate of 3000 houses were developed today without shops or any facilities there would be outcry and rightly so."

It was agreed that a further report be presented to the May meeting of the Area Committee.

Motion No.13 proposed by Councillor E.Walsh and seconded by Councillor T. McDermott .

“That the Manager arrange a C.P.O. to resolve the unacceptable derelict site at McHughs Shopping Centre St. James Road, Greenhills as this site has devalued the properties in the general area and has devalued the quality of life of the whole community and to be arranged as soon as possible.”

The report was noted and it was agreed to present a further report to the June meeting of the Area Committee.

The Council is facilitating Bus Stop Upgrade Works for Dublin Bus on sections of Routes 19A & 49 throughout the County. The purpose of the upgrade works is to replace existing Bus Stops with Kassel Kerbs to allow wheelchair/mobility impaired/buggies access to and from the new floor/wheelchair friendly type bus. The site on St. James Road is in use as a compound by SIAC Construction Ltd for the above scheme. Neither the Council nor the Consultant were involved in this arrangement whereby the site was to be used a a compound, it was a private arrangement between the contractor and the owner.  It is anticipated the completion of these works will be the end of July 2008, and it is expected that the contractor will occupy the compound until this date.

When the scheme is completed, the Contractor will vacate the site and reinstate it to its original condition prior to occupation.  The site will again be inspected having regard to the Derelict Sites Legislation.

Due to the Councils obligations which are reflected in the Capital Programme and the current financial climate it would not be possible to acquire the site at this time.
