Report of Tallaght Area Committee (2) – 31st March 2008

Planning Business

It was proposed by Councillor J. Daly and Seconded by Councillor M. Corr

“That this Committee calls on the Manager to compel the Department of Education to reinstate to its original condition the boundary of lands owned by them in the vicinity of Coolamber Drive and Stoney Lane in Rathcoole, that this Committee acknowledges the negative impact of this fencing on the residential amenity in this area and the acute danger that the current insuffient boundary represents to residents in the area in particular children, who now have easy access to this land through they ugly and inadequate fencing that is currently at Coolamber Drive and non-existing boundary treatment at Stoney Lane.”

The following Report by the Manager was READ.

The removal of the hedgerow at the boundary between Coolamber Drive and the Department of Education lands, and its replacement with a palisade fence is considered to be exempted development.  Accordingly, there is no action open to the Council to pursue the reinstatement of the hedgerow.

The provision or non-provision of a boundary treatment at Stoney Lane is a matter for the Department of Education.

Following a contribution from Councillor J. Daly, and Councillor M. Corr, Ms. M. Hunt, Administrative Officer responded to the queries raised.  It was proposed by Councillor J. Daly and Seconded by Councillor M. Corr and AGREED that the Motion be referred to the April County Council Meeting under Report of Area Committee.
