Re:    Proposed Disposal of 2 Plots of Land at Willsbrook, Lucan, Co. Dublin to John and Tom McGreevy, 5 Seafield Grove, Clontarf, Dublin 3 .

An application has been received from John and Tom McGreevy, 5 Seafield Grove, Clontarf, Dublin 3 to acquire 2 plots of Council owned land comprising 1,162 sq. metres or thereabouts at Willsbrook, Lucan, Co Dublin to incorporate with adjoining lands in their ownership.  The Council’s lands are located adjacent to the Lucan Educate Together N.S. and the proposed disposal of the plots referred to above were discussed with the Department of Education and Science. The Department has confirmed that it has no interest in the two small plots being disposed of  but may pursue the acquisition of the remaining lands at a future date.

Accordingly, I recommend that the Council dispose of 2 plots of land measuring 1,162 sq. metres or thereabouts at Willsbrook, Lucan, Co. Dublin as shown outlined in red and hatched in green on Drawing No. LA/15/08 to John and Tom McGreevy,  5 Seafield Grove, Clontarf, Dublin 3 in accordance with Section 211 of the Planning and Development Act, 2000 and subject to the provisions of Section 183 of the Local Government Act, 2001 subject to the following terms and conditions as recommended by the Council’s Valuer:-

1.  That the area to be disposed of is the two plots measuring 1,162 sq. metres(0.2871 acres)or thereabouts at Willsbrook, Lucan, Co.Dublin as shown outlined in red and hatched in green on Drawing No. LA/15/08.

2. That the disposal priced shall be calculated at the rate of €1,763,552 (one million, seven hundred and sixty-three thousand, five hundred and fifty-    two euro) per acre on the disposal area,  giving a total consideration of €506,316.00  (five hundred and six thousand, three hundred and sixteen euro) for the area to be disposed of, payable as follows:

         

(a)  50%  within one month of the date of the Council approving the disposal.

(b)  50% on the date of completion of the transaction

     Interest at the rate of 10% per annum shall apply to any outstanding amounts.

3.       That the land is disposed of with full freehold title and vacant possession.

4.       That each party shall be responsible for their own fees in this matter.

5.     No agreement enforceable at law is created or intended to be created until exchange of contracts has taken place.                                                                                  

The lands to be disposed of form part of lands acquired in 1982 from Mr & Mrs. Richardson for Housing and Roads purposes and from Dublin City Council in 1997 in accordance with the Scheme of Transfer of Lands under the Local Government (Dublin) Act 1993.
