Re:    Proposed disposal of section of laneway at rear of 33 Dunawley Grove, Clondalkin, Dublin 22 to Ms. Patricia Griffin

 

An application was received from Ms. Patricia Griffin 33, Dunawley Grove, Clondalkin, Dublin 22 to acquire an area of laneway to the rear of her property for incorporation into her garden.  The Public Right of Way over this laneway was extinguished on 12/11/2007 and the owners of three adjoining houses, which would be affected by the incorporation of this section of laneway have confirmed that they have no objections to this proposal

Accordingly, I recommend that the Council dispose of a plot of land measuring 10 square metres or thereabouts at the rear of 33 Dunawley Grove, Clondalkin, as shown outlined in red on Drawing no. LA/04/08, to Ms. Patricia Griffin in accordance with Section 211 of the Planning and Development Act, 2000 and subject to the provisions of Section 183 of the Local Government Act, 2001 subject to the following terms and conditions as recommended by the Council’s Valuer:-

1.                 That the Council dispose of the subject plot for the consideration of €1,000 (one thousand euro)

2.                 That the land is disposed of with full freehold title and vacant possession.

3.                 That the Council shall retain a wayleave to services that exist in the above land (if any).

4.                 That the applicant shall incorporate the subject plot into their rear garden and any boundary works shall be agreed with and carried   

                     out to the satisfaction of the Council.

5.                 That the applicant shall pay the Council’s legal fees.

The lands to be disposed of form part of lands acquired from Mr. Edward Dowd in 1966 for housing, roads and open space purposes.
