MOTION NO 6.

MOTION: Councillor C. Keane

"That this committee discussess the Willbrook Lawn open space in order that (a) we set a date for council work to commence on site taking into consideration we have agreed 15,000 in the budget for this work (b) that we write to both adjacent residents giving them a date for commencement/completion of construction of wall (c) that this committee agrees in the event of dates set not being adhered to that a temporary barrier be erected by this council outside the wall (on the open space) in order to allow the council access to the site to make the whole site available for community use. Taking into consideration that the community have been waiting many years for the use once again of this facility they once enjoyed as open space."

REPORT:

Following a meeting which took place between the residents of no. 29 and a representative for the residents of no. 31 Willbrook Lawn, officials of the Parks Department and representatives of the Willbrook Lawn Residents Association met on November 2. 2007 to explore means of resolving issues surrounding the proposed removal of hoarding on the open space at Willbrook Lawn. Three options were brought for consideration before the Terenure Rathfarnham Area Committee Meeting on November 13, 2007. 

A vote was taken by the elected members present at the meeting with 5 votes in favour of Option 2 and 2 votes in favour of Option 1.  In this regard, the Council’s decision is to pursue Option 2.

The Parks Department issued letters to the residents of nos. 29 and 31 Willbrook Lawns detailing the decision made at the Terenure Rathfarnham Area Committee Meeting on November 13, 2007 with regard to the removal of the hoarding on the open space.  They have been requested to make arrangements, as soon as possible, for the reconstruction of their respective boundary walls in order to enable the Council to progress with the recommendation of the Area Committee.

Following conversations by telephone with the residents of both no. 29 and no. 31 Willbrook Lawn, in response to the letters, the Parks Department understands that the residents of no. 29 are progressing the proposed reconstruction of their boundary wall with the open space in consultation with an Architect and that a site survey by the Architect has been carried out.

The proposed reconstruction may, depending on the height of the proposed wall, require a planning application to be made.

With regard to the residents of no. 31, the Parks Department is aware that the matter has been referred to their legal representatives. A request from the legal firm for clarification of Option 2 has been received by the Parks Department which has been responded to. The Parks department is expecting a response shortly. In view of the above it is not considered prudent for the Council to carry out work at this stage. The €15,000 provided in the Parks Works Programme was on the basis of the boundary issues being resolved.
