MOTION NO. 12

MOTION: Councillor J. Lahart

"That the Council outline the appropriateness of proceeding with the Part 8 plan for Kingston while the office of the Ombudsman is conducting an enquiry into the matter."

REPORT:

Section 4 (7) of the Ombudsman Act 1980 states "an examination or investigation by the Ombudsman shall not affect the validity of the action investigated or any power or duty of the person who took the action to take further action with respect to any matters the subject of the examination or investigation".

The Council has fully complied with the requirements of the Part 8 process both in spirit and in practice and a comprehensive report to this effect has been sent to the Ombusman.  Following full discussion the Part 8 was passed by the Area Committee Meeting on 3rd December 2007 and subsequently approved by the Council at its meeting on 10th December 2007.  A Notice of Intention to Proceed was published in the press on 6th February last.  All persons who made submissions have also been notified of intention to proceed.
