Re: Proposed disposal of land adjacent to 19 Glenpark Close, Palmerstown, Dublin 20– Mr & Mrs Roche
As part of the M50 motorway upgrade works on the N4 at Palmerstown a new boundary wall has been erected alongside the existing, one in the vicinity of Glenpark Close, Palmerstown, Dublin 20 This new boundary wall has resulted in the isolation of a piece of land some 600mm wide by 30 metres long, lying between the existing and new wall, as indicated on drawing no. CSK-19. As the piece of land in question is land locked and of no commercial value, the Director of Transportation and County Engineer has recommended that the strip of land be transferred to the ownership of Mr & Mrs Roche, 19 Glenpark Close, Palmerstown, Dublin 20 in order to regularise the road and land ownership boundary in the area, subject to the following terms and conditions:
1. That the plot is disposed of with full freehold title and vacant possession
2. That the plot shall be incorporated into the existing garden and shall be used for garden purposes only
3. That each party shall be responsible for their legal and other fees
4. That the above proposal is subject to the necessary consents and approvals being obtained
5. That no agreement enforceable at law is created or intended to be created until exchange of contracts has taken place
Accordingly, I recommend that the Council dispose of the plot of land comprising of 18 square metres or thereabouts adjacent to 19 Glenpark Close, as indicated on drawing no. CSK-19 to Mr & Mrs Roche in accordance with Section 211 of the Planning and Development Act, 2000 and subject to the provisions of Section 183 of the Local Government Act, 2001 subject to the above terms and conditions as recommended by the Director of Transportation and County Engineer.
The plot of land to be disposed of was acquired from John Dolan on 9th September, 1982 for roads purposes.
