MOTION: Councillor J. Lahart

"That the Manager take immediate definitive action against the resident/occupier of 28 Anne Devlin Avenue in light of continuous complaints and enforcement proceedings including court action taken many years ago on foot of enforcement proceedings initiated by this local authority which are allegedly being flouted and ignored in spite of repeated requests from this Councillor."

REPORT:

A Warning Letter pursuant to Section 152 of the Planning and development Act 2000 was served on the owners of 28 Anne Devlin Avenue on 24 August 2007 concerning an alleged unauthorised operation of a business from the dwelling. 

A submission in response to the Warning Letter has been considered, and an Enforcement Notice dated 21st December 2007 was served requiring that  the operation of a business from the dwelling cease on or before 14th January 2008.
