Kildare Route Project Supplementary Development Contributions Scheme (SDCS)
South Dublin County Council has prepared a draft Supplementary Development Contribution Scheme (SDCS) under Section 49 of the Planning and Development Act 2000 (as amended).
The draft Scheme is for the Iarnrod Eireann (Irish Rail) Kildare Route Project and applies to an area of 1,807 hectares either side of the railway line within the South Dublin County Council administrative area (Map).
The Kildare Route Project includes the provision of two extra tracks alongside the existing two-track railway line and new stations at Fonthill Road (Clonburris) and Kishoge in the South Dublin County area. This will facilitate a significantly increased level of suburban rail service in the County.
South Dublin County Council commissioned an economic assessment in order to determine the appropriate rate of levy for the draft Scheme having regard to, inter alia, the cost of the Project in the South Dublin area, the quality of service to be provided by the Project and the estimated benefit to different classes of future development.
Accordingly, the draft Scheme proposes contributions at the following rates:
Residential Development €1,900 per unit
Commercial Development €22.35 per m2
Retail Development €29.00 per m2
The draft scheme was presented to the County Council in July 2007, advertised and displayed in public for six weeks from September – November 2007. One submission was received during the public display period.
In accordance with the statutory procedure for Supplementary Development Contribution Schemes as set out under Section 49 of the Planning and Development Act 2000 (as amended) a Manager’s Report has been prepared. The purpose of the Manager’s Report is to report on the written submission received following the public display of the Scheme (SDCS) and to give the response of the Manager to the issues raised.
The submission received during the 6 week period was made by the Department of the Environment, Heritage and Local Government and refers to the lack of any exemptions from the requirements of the Supplementary Development Contribution Scheme for protected structures or structures of architectural heritage merit. The submission recommends that consideration be given to the inclusion of exemptions for works to protected structures.
In recognition of the issues raised in the submission and South Dublin County Council’s commitment to securing the preservation of the County’s Architectural Heritage, it is considered appropriate to include a full exemption from the requirement to pay development contributions under this scheme, for works to protected structures.
The Manager’s Report was noted by the Lucan-Clondalkin Area Committee on 5th December.
Prior to noting the Manager’s Report, the Lucan-Clondalkin Area Committee passed a motion recommending that full exemption be extended to childcare facilities, including those in private homes and purpose-built crèches operated on a commercial basis. It is agreed that Section 6 of the draft SDCS be amended accordingly and that this be recommended to the County Council, with the Manager’s Report.
The legislation provides that following consideration of the Manager’s Report and having regard to any recommendations made by the Minister, the Planning Authority shall make the Supplementary Development Contribution Scheme unless it decides by resolution to vary or modify the scheme, otherwise than as recommended in the managers report, or otherwise decide not to make the scheme.
The Manager’s Report includes a Resolution to make the Kildare Route Project SDCS. For information the full draft SDC Scheme and Scheme map is appended to the Manager’s Report.
