That this Committee supports the residents of Saggart Village in their opposition to the sale of the Village Green to facilitate the development set out in planning application SD06A/0636 which has been refused by SDCC Planning Dept but upheld on appeal to An Bord Pleanala recently.

REPORT:

The Council issued a letter of comfort to Hannah Homes Ltd, the owners of a property at Saggart Village, to include two strips of adjoining Council owned land as shown hatched in red on attached Drawing, for the purpose of submitting a planning application for the re-development of their property. This application, Planning Reg. Ref. SD06A/0636 was subsequently granted planning permission by An Bord Pleanála. The Council's lands included in the planning application are to facilitate a new pedestrian street and car-parking for the development. One of the strips of Council land included in the application is located at the Village Green and comprises the area from the boundary of the private property extending out to existing pathway. The planning permission granted envisages that this area is to be upgraded to a pedestrian street fronting the proposed development, with associated landscaping. The remainder of the Village Green is not part of the application. The other strip of land at Saint Mary's Park which constitutes a roadside verge at present, is to facilitate on-street car-parking as per the planning permission.

In view of the decision by An Bord Pleanála to grant permission in this case and provided that the applicants wish to proceed with the development, the next step for the Development Department is to obtain reports on services or particular requirements from other Council Departments and Utility Companies in relation to the portion of Council lands included in the planning permission. On receipt of these reports, the Council’s Valuer will be instructed to open negotiations with Hannah Homes Ltd regarding the disposal /licensing of the lands and should terms be agreed between the parties, these will then be put to the members for consideration at a full Council meeting.
