PROPOSED EXTINGUISHMENT OF PUBLIC RIGHT OF WAY AT REAR OF 99 - 103 LIMEKILN ROAD, WALKINSTOWN, DUBLIN 12.

The attached report was considered at the Terenure/Rathfarnham Area Committee Meeting (1) on 2nd October, 2007.
It was proposed by Councillor E. Walsh, seconded by Councillor C. Keane and AGREED:
"That this Committee recommends to the Council that the public right of way at the rear of 99 - 103 Limekiln Road, Walkinstown, Dublin 12 as shown coloured red on Drawing No. RE 0701 be extinguished."
The extinguishment is to be effected by means of a gate.
The decision regarding the extinguishment of a public right-of-way is a reserved function of the Council.
If the Council agrees to the recommendation, the following resolution is required:
South Dublin County Council in pursuance of its power under Section 73 of the Roads Act, 1993 hereby orders that the public rightof-way at the rear of 99 - 103 Limekiln Road, Walkinstown, Dublin 12, as shown coloured red on Drawing No RE 0701 be extinguished.

The following report was considered at the Terenure/Rathfarnham Area Committee Meeting on Tuesday 1st May, 2007.
An application has been received from Development Department and the residents of 99 103 Limekiln Road to formally extinguish the public right-of-way at the rear of 99 - 103 Limekiln Road, Walkinstown, to affect the closure by means of incorporation into the garden of 99 Limekiln Road and access to be maintained to 101 and 103 Limekiln Road by means of a gate.
Following consideration of the report, it was agreed to initiate the procedure.
The proposal to extinguish the public right-of-way was advertised in the Echo on Wednesday 16th May 2007 and signs were erected on site in accordance with Section 73 of the Roads Act, 1993. the latest date for receipt of objection, representations and requests for an oral hearing was Friday 29th June, 2007.
No submissions were received in response to the public advertisement/notice.
Bord Gais, Eircom, NTL have stated that they have no objection to the proposed extinguishment.
ESB has no objections to the proposed extinguishment but they require contact be made with them in advance of any works taking place.
Public Lighting and Water and Drainage Sections have no objections to the proposed extinguishment.
The decision regarding the extinguishment of a public right-of-way and the granting of an oral hearing is a reserved function of the Council.
Any recommendation of the Committee will be brought to the attention of the Council.
