MOTION NO. 6

MOTION: Councillor E. Walsh

"That the Manager in view of the failure of the developer of the derelict shopping centre site to proceed with the development as agreed last May that the C.P.O. be re-introduced and to state that local residents are sick and tired of the false promises as they look onto a most offensive site in the heart of its community."

REPORT:

The Planning Department has advised that there is no legislation in place which requires that a proposed development contained in a permission be commenced by a specific date. A planning permission has a duration of five years, beginning on the date of grant of permission, unless otherwise specified.

The developer of the land in question has indicated that he proposes to commence development shortly. An application for a Fire Safety Certificate has been submitted to Dublin Fire Brigade and a decision was due on 1st November, 2007. However, Dublin Fire Brigade has looked for an extension of time to consider the application and the decision due date is now 3rd December, 2007.

The owners have indicated that on receipt of a Fire Safety Certificate, that they intend lodging a commencement notice with the Council. While the developer of the land in question had inciated that he proposed to commence work in late October or early November, this has now been delayed slightly, because of the request from Dublin Fire Brigade for the extension of time to consider the application for the Fire Safety Certificate. It is hoped now that the development will commence early in the New Year.
