PROPOSED EXTINGUISHMENT OF PUBLIC RIGHT OF WAY AT THE SIDE OF MAPLEWOOD PARK, OLD BLESSINGTON ROAD, TALLAGHT, DUBLIN 24.

The following report was considered at the Tallaght Area Committee Meeting on 25th June, 2007.

That this Committee recommends the closure of the pedestrian access to Maplewood Park (new houses) which has led to the increase of anti-social behaviour and criminal damage to property from people using this as a cut through late at night.

Following consideration of the report, it was agreed to initiate the procedure.

The proposal to extinguish the public right-of-way was advertised in the Echo on Wednesday 11th July, 2007 and signs were erected on site in accordance with Section 73 of the Roads Act, 1993. The latest date for receipt of objections, representations and requests for an oral hearing was 24th August, 2007.

The following is a breakdown of the submissions received in response to the public advertisement/notice:-

Bord Gais, NTL have stated that they have no objection to the proposed extinguishment.

Eircom object as there is a Plant at this location.

ESB have no objection but request it be noted that there are high voltage underground cables in the area concerned.

Public Lighting and Water and Drainage Sections have no objections to the proposed extinguishment.

The decision regarding the extinguishment of a public right-of-way and the granting of an oral hearing is a reserved function of the Council.

Any recommendation of the Committee will be brought to the attention of the Council.
