(a) CO-OPTION OF NEW MEMBER FOLLOWING RESIGNATION OF COUNCILLOR A. WHITE

Councillor Alex White was elected to Seanad Éireann on 23rd July 2007. Pursuant to Section 2 of the Local Government (No. 2) Act, 2003 his election to Seanad Éireann disqualifies him from being a member of South Dublin County Council.

By letter dated 10th August 2007 Cllr. White has duly tendered his resignation in accordance with Section 18 of the Local Government Act, 2001.

Section 19 of the Local Government Act 2001 provides that a casual vacancy shall be filled by the co-option by the local authority of a person to fill the vacancy, subject to such person being nominated by the same registered political party who nominated for election or co-option the member who caused the casual vacancy, and that such co-option shall be made at the next meeting of the local authority after the expiration of 14 days from the occurrence of the vacancy or as soon after the expiration of the 14 days as circumstances permit.

By email dated 2nd October 2007 Mr. Patrick Cosgrave has been duly nominated by the Labour Party, being the registered political party who nominated Cllr. White for election.

In accordance with Section 19(5) Mr. Cosgrave’s written consent to his proposed co-option has been received.

It is now a matter for the Council to co-opt the new Member in accordance with the procedure set out in Section 19(3) of the Local Government Act, 2001.
