Re: Proposed disposal of portion of land adjacent to 68 Castle Park, Tallaght, Dublin 24 - Mr. Gerald Kavanagh - Variation of terms

The Council at its meeting held on 12th February 2007 noted the disposal of a portion of land adjacent to 68 Castle Park, Tallaght, Dublin 24 to the houseowner Gerald Kavanagh by way of a 99 year lease to be incorporated into his garden. Minute No. (C/0063/07) refers.

The applicant subsequently indicated that he wished to purchase the freehold interest in lieu of the leasehold interest in the land and the Council’s Valuer was requested to recommend revised terms and conditions.

I now recommend that the Council dispose of the freehold interest in an area measuring 55 square metres or thereabouts adjacent to 68 Castle Park, Tallaght, as shown outlined in red on Drawing No. LA/20/06 to the respective householder, Gerald Kavanagh in accordance with Section 211 of the Planning and Development Act, 2000 and subject to the provisions of Section 183 of the Local Government Act, 2001 and that the disposal now be subject to the following revised terms and conditions as recommended by the Council’s Valuer:-

1. That the area be disposed for garden purposes only.

2. The applicant to pay to the Council the consideration of €3,325.00 (three thousand, three hundred and twenty five Euro).

The terms and conditions otherwise to remain unchanged.

The lands to be disposed of form part of lands acquired from Siobháin O Dea in 1964 for housing purposes.
